Terms & Conditions


1.1. Right of Withdrawal – The Consumer's right to unilaterally withdraw from the contract (cancel the order) within a specified period without paying a penalty, interest, or damages. The rights of withdrawal, procedures, and the period in which the right of withdrawal can be exercised are determined by the Consumer Rights Protection Law and the Cabinet of Ministers Regulation No. 255 "Regulations on Distance Contracts" of May 20, 2014 (hereinafter referred to as the Regulations on Distance Contracts).

1.2. Prices – The prices of the respective goods indicated in the online store at which the Seller offers them for purchase.

1.3. Online Store – The website maintained by the Seller at www.shroomium.eu, through which the goods offered by the Seller can be purchased.

1.4. Payment Date – The date on which the Seller has received full payment in its account for the goods indicated in the respective order.

1.5. Consumer – A natural person who expresses the desire to purchase, purchases, or may purchase or use a product or service for a purpose not related to their economic or professional activity.

1.6. Seller – "Fazette" SIA, registration number 40203094388, legal address: Brīvības iela 40 - 30, LV-1050, Rīga, Latvia.

1.7. Buyer – The person who places an order for goods in the Online Store. The Buyer can be either a Consumer or a person who is not a Consumer.

1.8. Shopping Cart – The goods selected by the Buyer in the Online Store.

1.9. Parties – The Buyer and the Seller.

2. Operation of the Terms

2.1. The Terms define the legal relationship between the Buyer and the Seller.

2.2. In addition to these terms, the legal relationship between the Parties is governed by the Civil Law, the Commercial Law, the Consumer Rights Protection Law, and other legal acts of the Republic of Latvia.

2.3. The provisions of the Consumer Rights Protection Law and other legal acts governing consumer rights do not apply to legal relationships between the Seller and the Buyer who is not a Consumer.

2.4. The order confirmation, which specifies the particular goods and their prices, is considered part of the contract concluded between the Parties.

2.5. The Seller reserves the right to amend and supplement these terms. Changes to these terms come into effect from the moment of their publication on the website www.shroomium.eu and apply to orders placed after the changes are published.

3. Product Descriptions and Prices

3.1. Product descriptions, specifications, and prices are indicated in the Online Store in the selection window for each respective product. If needed, additional information about the product can be obtained by contacting the Seller’s customer service consultants by phone at +371 28750004 or by writing to [email protected].

3.2. The prices are valid for timely payments, i.e., when payment is made within the term specified in section 5.3 of these terms.

3.3. Prices are indicated inclusive of all taxes. Delivery costs are not included in the price. The Buyer can choose the delivery method for the fee indicated on the website www.shroomium.eu.

3.4. The range of goods and prices may change without prior notice. Changes come into effect from the moment of their publication on the website www.shroomium.eu and apply to orders placed after the changes are published.

4. Shopping Cart and Order Processing

4.1. The shopping cart is created when the Buyer selects the respective product and uses the “Add to Cart” option.

4.2. After all selected goods have been placed in the shopping cart, use the "Order" option on the right side of the page.

4.3. The shopping cart shows all selected goods. The quantity of goods in the shopping cart can be adjusted. To proceed with the order, the required information must be entered.

4.4. The order is considered completed and becomes binding on the Parties when the Seller has received the Buyer's order and sent an order confirmation to the Buyer's email address (or otherwise). The goods will only be handed over to the Buyer after full payment of the order. The Buyer is not entitled to receive the goods before full payment is made.

5. Payment Procedures

5.1. By placing an order in the E-store, the Client agrees to the price of the selected product and its payment terms.

5.2. Product prices in the E-store are indicated in EUR, including taxes, such as value-added tax. The delivery fee (if applicable) is determined separately, depending on the chosen delivery method and delivery address, according to the E-store's delivery rates.

5.3. The Client can make the payment for the order:

5.3.1. at the time of order placement in the E-store, using internet banking "bank-link" services;

5.3.2. using MASTERCARD and VISA payment cards;

5.3.3. by bank transfer to the account indicated in the invoice within 2 business days after receiving the invoice.

6. Delivery Procedure and Delivery Charges

6.1. Delivery of goods is subject to a fee, which is not included in the price of the goods. Information on delivery charges can be found in the “Delivery Method” section of the Online Store.

6.2. The delivery method can be selected when placing the order in the “Delivery Method” section.

6.3. Goods will only be delivered if the order has been paid in full, and the Seller has received full payment in its account for the goods and delivery specified in the respective order.

6.4. Goods are delivered by a courier. The goods are delivered to the address or parcel locker specified in the Buyer's order.

6.5. If necessary, the Parties agree on the delivery time by phone or email, with the Seller or courier contacting the Buyer using the phone number provided in the order. The Buyer can contact the Seller regarding delivery-related questions by calling the Seller's phone numbers provided in the Online Store.

6.6. The maximum delivery time for goods available in the Seller's warehouse within the territory of the Republic of Latvia is 7 (seven) business days after the payment date. Typically, delivery of goods is made no later than 2 (two) business days after the payment date.

6.7. For goods that are not available in the Seller’s warehouse and for delivery outside the territory of the Republic of Latvia, the Parties agree separately on delivery time and possibility.

6.8. If the Seller cannot fulfill the order because the ordered goods are unavailable, the Seller may deliver equivalent goods at an equivalent price. If the Buyer, who is a Consumer, exercises the right of withdrawal, the Seller covers the costs related to returning the goods. If the Seller does not deliver equivalent goods at an equivalent price, they will inform the Buyer and refund the Buyer’s entire payment no later than 30 (thirty) calendar days from the day the Seller received the Buyer’s order.

6.9. To ensure the fastest possible delivery, full and accurate delivery information should be provided (e.g., door code, floor, specific building entrance if there are multiple, etc.). The Seller is not responsible for delivery delays caused by incomplete or inaccurate information provided by the Buyer.

6.10. After receiving the payment, the Seller will send the Buyer a confirmation email, including a delivery note – an invoice.

6.11. Before receiving the goods, the Buyer must present identification (ID card, passport, or driver's license). If the Buyer is a natural person and the goods are collected by an authorized representative, a notarized power of attorney must be provided. If the Buyer is a legal entity, the recipient must provide documents confirming representation rights.

6.12. Before accepting the goods and signing the invoice, the Buyer must check the condition of the goods packaging. If damage to the packaging or goods is found, the Buyer must report it to the Seller at [email protected] or by phone at +371 28750004.

7. Information on the Right of Withdrawal and Returning Goods to the Seller

7.1 The Consumer has the right to exercise the Right of Withdrawal within 14 (fourteen) calendar days from the day the Consumer receives the goods or part of the goods.

7.2. The Right of Withdrawal is exercised by submitting a written application (in free form or using the withdrawal form) to the Seller, indicating the order number, product name, order amount, Consumer’s name, personal code, address, phone number, and refund details. Sending the withdrawal notice within the specified period terminates the contract and releases the Consumer from any contractual obligations, except for the costs related to returning the goods to the Seller. Goods can be exchanged for others if they retain their appearance, consumer properties, original packaging, and labeling, and have not been used. The withdrawal form can be requested from the Seller by sending an email to [email protected].

7.3. The Consumer is obliged to return the goods to the Seller within 7 (seven) days after sending the written withdrawal notice (if the goods have been received). The Seller is obliged to refund the amount paid for the goods to the Consumer within 14 (fourteen) days from the receipt of the Consumer’s written withdrawal notice. The refund is made using the same payment method that the Consumer used for the transaction. The Seller has the right to withhold the refund until the Consumer returns the goods or provides documents confirming the return or dispatch of the goods. The Seller has the right to refuse the withdrawal or deduct compensation if the goods or their packaging are damaged.

7.4. The item to be returned must be sent to the Seller at the following address: Brīvības iela 40-30, Rīga, LV-1050, Rīga, Latvia.

7.5. The Consumer is responsible for maintaining the quality and safety of the item during the withdrawal period. The Consumer is liable for any reduction in the value of the item if the item has been used in a manner inconsistent with the principle of good faith, including any use other than for determining the item's characteristics or functionality.

7.6. The item to be returned must be in full completeness.

7.7. The Consumer cannot exercise the right of withdrawal in cases specified in Article 22 of the Regulations on Distance Contracts, including if:

7.7.1. the price of the goods depends on fluctuations in the financial market which the Seller cannot control;

7.7.2. the Consumer has opened the packaging of the item.

  1. Warranty and Consumer’s Claims for Non-Conforming Goods

8.1. The goods offered in the online store are subject to the manufacturer's warranty during the usage period. The warranty does not affect the rights granted to the Consumer by the law.

8.2. Regardless of the manufacturer's warranty, the Consumer is entitled to file a claim with the manufacturer or the Seller for non-compliance with the terms of the contract, as per the Consumer Rights Protection Law and other legal requirements, within the statutory period. The day of purchase of the item is considered to be the day when the manufacturer or Seller delivered the item and the Consumer accepted it.

8.3. When submitting a claim to the manufacturer or Seller regarding non-compliance with the contract, the Consumer must attach a copy of the transaction receipt. The Consumer can submit complaints about product unavailability or quality by emailing [email protected]. If the complaint is deemed unfounded or the Consumer disagrees with the decision, the Consumer has the right to use dispute resolution methods provided by the law. Information about out-of-court dispute resolution options is available at www.ptac.gov.lv.

  1. Other Provisions

9.1. The distance contract between the Buyer and the Seller comes into effect once the Seller has received the Buyer's order and sent an order confirmation to the Buyer's email address (or otherwise), and remains in effect until its execution (payment and delivery of goods), or in the case outlined in clause 5.4 of these terms.

9.2. The Parties are responsible for damages caused to the other Party.

9.3. Information about the processing and protection of data provided by the Buyer is outlined in the "Privacy Policy" section of the online store.

9.4. The legal relationship between the Parties is governed by the laws of the Republic of Latvia. Disputes between the Parties are resolved through mutual negotiations. If the Parties cannot reach an agreement, the dispute will be reviewed by the courts of the Republic of Latvia. The Consumer also has the right to approach the Consumer Rights Protection Centre.

  1. Notice to Buyers

10.1. The assortment and prices of goods may change without prior notice. Manufacturers may change product specifications without prior notice to the Seller. Product descriptions use information and images provided by the manufacturer.

10.2. The Seller requests that Buyers report any discrepancies in product descriptions or images by contacting the Seller's customer service representatives by phone at +371 28750004 or by email at [email protected].

10.3. All images and descriptions in the online store are intended to provide complete and accurate information about the goods. If necessary, to clarify product specifications or related information before making a purchase, please contact the Seller’s customer service representatives by phone at +371 28750004 or by email at [email protected].
